These Terms & Conditions outline our policies regarding website use, purchases, live poultry, customer responsibilities, product availability, guarantees, refunds, and other important information.

Please review these terms before making a purchase or participating in our programs.

By placing an order through our website, accepting these terms during checkout, or purchasing products from our farm after these terms have been provided to you, you acknowledge and agree to the applicable provisions of this agreement.

Certain food products offered through this website may be produced or sold by Southern Acre Farm, LLC, a separate business operating in association with Charley’s Chicks.

For products sold by Southern Acre Farm, LLC, the seller identified in the applicable transaction remains responsible for that sale. References to Charley’s Chicks in these Terms include Southern Acre Farm only where expressly applicable.

Throughout this agreement, the terms “Charley’s Chicks,” “we,” “us,” and “our” refer to the applicable business offering the product or service.

The terms “customer,” “purchaser,” “you,” and “your” refer to any person accessing our website, visiting our farm, or purchasing our products and services.

Terms and Conditions

⏺Website Use and General Information

Our website provides information regarding poultry breeds, available livestock, custom poultry feeds, equipment, educational resources, events, and other products and services offered by Charley’s Chicks. While we make reasonable efforts to keep our website accurate and current, information may change without notice.

This includes:

  • Product availability and inventory.

  • Poultry ages, breeds, and quantities.

  • Prices and promotional offers.

  • Scheduled hatch dates and pickup availability.

  • Product descriptions and specifications.

  • Farm operating hours and appointment availability.

We reserve the right to correct errors, update information, discontinue products, and make reasonable adjustments to our offerings. Any material change to an accepted order will be communicated to the customer. Changes to website information do not retroactively change the agreed terms of an existing purchase without the customer’s consent where required by law.

Customers must be at least 18 years of age or have the authorization of a parent or legal guardian to make purchases through our website.

⏺Live Poultry Purchases

Charley’s Chicks specializes in raising and selling live poultry in a variety of breeds and ages. Our livestock offerings may include day-old chicks, growing pullets, ready-to-lay chickens, meat birds, bantams, turkeys, guineas, waterfowl, and other poultry.

All customers purchasing live poultry acknowledge that they are purchasing living animals, not manufactured products.

Unlike conventional retail merchandise, poultry are subject to natural biological development, environmental influences, and individual variation.

Age, size, appearance, feathering, coloration, temperament, maturity, reproductive development, and other characteristics may vary between individual birds of the same breed. Photographs and breed descriptions displayed on our website are intended to illustrate general characteristics and may not represent the exact bird a customer receives. We do not guarantee that a purchased bird will develop the exact appearance, personality, size, feather pattern, or egg production characteristics shown in photographs or described in general breed information.

Specific representations expressly included in an individual sale remain subject to applicable law and the terms of that sale.

Responsibility of Ownership

By purchasing live poultry, customers acknowledge their responsibility to provide appropriate care, housing, nutrition, water, protection, and environmental conditions suitable for the age and species purchased.

Our team is happy to provide general care recommendations, but the ultimate responsibility for maintaining the welfare of purchased poultry belongs to the owner after pickup.

⏺Poultry Availability and Inventory

Charley’s Chicks raises poultry throughout the year, with inventory continuously changing as birds are purchased, grow, mature, or become unavailable.

Our Current Availability page is intended to provide customers with an updated reference of poultry available at the farm. However, a bird appearing on our Current Availability list does not constitute a guaranteed reservation. Inventory is subject to prior sales and other changes until an order is confirmed.

Availability may also change because of:

  • Hatch success and hatchery availability.

  • Developmental or health concerns.

  • Unexpected livestock mortality.

  • Transportation delays.

  • Changes in breeding or production schedules.

  • Circumstances affecting the health or welfare of our animals.

Charley’s Chicks reserves the right to remove livestock from availability when necessary to protect the welfare of the animal or the health of our broader flock. If a customer purchases a bird that subsequently becomes unavailable before pickup, we will contact the customer to discuss an appropriate alternative. Depending on the circumstances, the customer may be offered another available bird, a revised pickup date, or a refund for the unavailable portion of the order.

Breed substitutions will not be made without the customer's approval.

⏺Sexed Pullets and Gender Accuracy

Charley’s Chicks specializes in raising sexed pullets for customers seeking female chickens for backyard egg production. Sexed pullets are chicks identified as female through an established poultry-sexing process. Although these techniques are generally reliable, they are not guaranteed to be 100% accurate. Our standard-size layer breeds are generally sold as sexed pullets with an average expected accuracy of approximately 80% - 90%.

Customers acknowledge that a small percentage of birds purchased as female may develop into males. A bird that develops into a rooster does not automatically constitute a defective product or qualify for a refund under our 5-Day Guarantee.

Instead, eligible birds may qualify for our Rooster Exchange Policy.

Straight-Run Poultry

Certain poultry are sold as straight-run, meaning males and females have not been identified, separated or guaranteed.

Unless specifically advertised otherwise, straight-run poultry may include:

  • Meat birds.

  • Bantam breeds.

  • Turkeys.

  • Guineas.

  • Waterfowl.

  • Other specialty poultry designated as straight-run.

Straight-run poultry do not qualify for our Rooster Exchange Policy. Customers should review the gender classification of each breed before completing a purchase.

⏺Rooster Exchange Policy

We understand that an unexpected rooster can create challenges for backyard chicken owners, particularly in residential communities where roosters may not be permitted. To assist customers who purchase sexed pullets, Charley’s Chicks offers a Rooster Exchange Policy for qualifying birds.

If a chicken purchased from Charley’s Chicks as a sexed pullet develops into a rooster, the customer may request an exchange under the following conditions:

  1. The rooster must have reached at least 12 weeks of age before being returned.

  2. The rooster must be returned before reaching six months of age.

  3. The customer must provide proof of purchase.

  4. The bird must have originally been purchased as a sexed pullet.

  5. A $5 exchange fee applies per bird.

  6. The replacement will be a female chicken of comparable age and the same general breed-price category, subject to availability.

We cannot guarantee an exact breed-for-breed replacement. Eligible replacement categories may include Standard, Specialty, or Rare breeds, as applicable to the original purchase. If an appropriate replacement is not immediately available, our team will discuss available options with the customer.

The Rooster Exchange Policy is separate from the 5-Day Guarantee.

We do not offer refunds for healthy chickens solely because they develop into roosters. Charley’s Chicks does not accept general rooster surrenders or offer the purchase of roosters through this exchange program. Acceptance is limited to qualifying birds originally purchased from our farm.

⏺Five-Day Live Poultry Guarantee

At Charley’s Chicks, we work hard to raise healthy poultry and help our customers begin their backyard flock experience with confidence. Our 5-Day Guarantee is intended to provide reasonable protection in the unfortunate event of a qualifying loss shortly after a bird goes home.

Guarantee Period

The guarantee applies for five calendar days beginning on the date the customer takes physical possession of the purchased poultry. The pickup date is considered Day One.

Covered Losses

If a bird passes away from unknown causes during the guarantee period, customers may submit a claim for review.

A qualifying claim requires:

  • Proof of purchase.

  • A clear photograph of the deceased bird.

  • Submission of the guarantee claim within the five-day period.

  • Any additional information reasonably necessary to identify the bird and review the circumstances.

Claims may be submitted through our website's 5-Day Guarantee form. Customers experiencing concerning health symptoms in a recently purchased bird should contact our Chick Care Team promptly so we can help evaluate the situation.

Replacement Policy

For an approved mortality claim, Charley’s Chicks will provide a replacement bird at no additional charge. We will make all reasonable efforts to replace the bird with the same breed and a comparable age. If the original breed is unavailable, we may offer an alternative breed or a refund of the original purchase price for the affected bird. Customers are not required to accept a different breed.

Approved replacements must be arranged and picked up within seven days of claim approval unless another arrangement is agreed upon.

Guarantee Exclusions

The guarantee is not intended to cover losses caused by circumstances unrelated to the condition of the poultry at the time of sale.

Examples may include:

  • Predator attacks or physical injuries occurring after pickup.

  • Inadequate heat or improper brooder temperatures.

  • Dehydration or lack of access to appropriate food and water.

  • Unsafe housing or environmental conditions.

  • Improper handling or transportation.

  • Injuries caused by existing flock members.

  • Exposure to disease or parasites after pickup.

  • Other circumstances shown to have caused the loss after the bird entered the customer's care.

A loss occurring during the guarantee period will be reviewed based on the available information rather than automatically denied because the bird has left the farm.

Additional Expenses

Our guarantee provides the remedies described above. Unless required by applicable law or separately agreed in writing, Charley’s Chicks does not reimburse veterinary expenses, transportation costs, lost egg production, feed expenses, housing costs, or other incidental expenses associated with a purchased bird.

Nothing in this policy limits any rights or remedies that cannot lawfully be excluded.

⏺Ready-to-Lay Pullet Program

Our Ready-to-Lay Pullet Program allows customers to purchase growing female chickens approaching reproductive maturity. This program is designed for customers who want to bypass the early brooder stage and introduce older pullets into their backyard flock. Ready-to-lay pullets are generally offered beginning around 16 weeks of age, although individual program ages may vary.

Egg Production

The term “Ready to Lay” refers to the bird's general developmental stage. It does not mean the chicken is actively laying eggs or guaranteed to begin laying within a specific period. The age at which a chicken begins laying varies according to breed, genetics, nutrition, seasonal daylight, environmental conditions, stress, and individual development. Some birds may begin laying around six months of age, while others mature earlier or later.

Charley’s Chicks does not guarantee a particular first-egg date, daily egg production, annual egg quantity, egg color consistency, or reproductive performance.

RTL Orders and Cancellations

Ready-to-Lay purchases reserve specific livestock for the customer. Once an RTL order has been placed and accepted, customer-requested cancellations, changes, or refunds are generally not permitted. This does not affect remedies available under our 5-Day Guarantee, Rooster Exchange Policy, applicable law, or circumstances where Charley’s Chicks is unable to fulfill the order.

RTL Pickup Requirements

Unless a different pickup date is expressly stated in the order confirmation, purchased Ready-to-Lay pullets must be picked up within five calendar days of purchase. A further two-business-day grace period will be provided for customers who have not completed pickup. Following the expiration of the grace period, a boarding fee of $5 per day may be assessed for continued care of the purchased poultry.

Any applicable boarding fees must be paid before the order is released. Customers experiencing difficulty completing pickup should contact us as soon as possible. We encourage timely pickup to ensure that poultry transition into their permanent home at the appropriate developmental stage.

⏺Preorders and Scheduled Hatch Dates

Charley’s Chicks offers advance purchasing opportunities for certain poultry, including day-old chicks, meat birds, and scheduled Ready-to-Lay programs. Preorders allow customers to plan their flock in advance and reserve available inventory.

Hatch-Date Estimates

Hatch dates and scheduled poultry arrivals are based on anticipated production schedules and availability from our breeding and hatchery partners. Although we work to meet advertised dates, successful hatching involves natural biological processes that are not completely predictable. Factors such as fertility, hatchability, weather, logistical delays, and unexpected mortality can affect the number of birds available. For this reason, scheduled hatch dates are subject to reasonable changes.

Hatch Shortages

If fewer chicks are available than anticipated, Charley’s Chicks may be unable to fulfill every order exactly as originally placed. Affected customers will be contacted regarding available alternatives.

These may include:

  • Accepting a different available breed.

  • Moving the unfulfilled portion of an order to another available hatch date.

  • Receiving a refund for the unfulfilled portion of the order.

Charley’s Chicks will not substitute a different breed without customer approval.

Customer Cancellations

Once a preorder has been accepted and livestock has been reserved, customer-requested cancellations may not be available. Customers should verify their breed selections, quantities, and anticipated pickup dates before completing payment. If Charley’s Chicks cannot reasonably fulfill an order and the customer does not accept an available alternative, the customer will receive a refund for the affected portion of the purchase.

⏺Live Poultry Pickup and Transportation

Unless expressly advertised otherwise, live poultry purchases are for pickup at our farm.

Customers are responsible for reviewing their order confirmation and arranging pickup within the applicable period.

Transportation Requirements

Customers are responsible for providing safe transportation appropriate for the age, size, and number of birds purchased.

This includes:

  • Adequate ventilation.

  • Appropriate temperature control.

  • Suitable transport containers.

  • Protection from direct sunlight and extreme weather.

  • Avoidance of overcrowding.

  • Prompt transportation to the birds' permanent housing.

Young chicks are particularly vulnerable to temperature changes and should be transported directly to a properly prepared brooder. Customers should have appropriate housing, heating, bedding, food, and water prepared before collecting their birds. Charley’s Chicks may delay the release of poultry when an immediate transportation or welfare concern presents a substantial risk to the animals.

Uncollected Orders

Customers who cannot complete pickup within the agreed period must contact us to discuss available arrangements. Orders left uncollected for an extended period may be subject to additional care charges and eventual cancellation after reasonable notice, subject to applicable law. Any refund, cancellation charge, or other financial resolution will be determined according to the disclosed terms applicable to the order.

We encourage customers to communicate with us promptly rather than allowing a pickup deadline to pass without notice.
